General Terms and Conditions of Sale
Terms governing purchases, payment, delivery, legal guarantee and withdrawal on Valdiverdura Shop.
Art. 1 – General provisions
By browsing this area, the user accesses shop.valdiverdura.com. Browsing and submitting a purchase order implies acceptance of these Terms and the data-protection policies indicated on the website.
These General Terms and Conditions apply to products purchased through the website in accordance with Part III, Title III, Chapter I of the Italian Consumer Code (Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014) and Legislative Decree No. 70/2003, from Società agricola Valdiverdura s.s., Contrada Castellana, 92016 Ribera (AG), Italy, VAT No. 02700340843.
The customer is invited to read and retain a copy of these Terms. Valdiverdura may update the terms applicable to future purchases; confirmed orders remain governed by the conditions applicable when they were placed.
Art. 2 – Scope
These Terms govern the offer, submission and acceptance of orders for products on shop.valdiverdura.com. They do not govern products or services supplied by third parties that may be linked from the website. Before buying from a third party, customers should review that party’s terms.
Art. 3 – Formation of the contract
To conclude a purchase contract, the customer completes and submits the electronic checkout process following the instructions on the site. Before confirmation, the customer can review product information and prices, available payment methods, delivery arrangements and applicable costs, withdrawal information and personal-data information.
The contract is concluded when the seller receives the completed order after verification of the information provided. The customer becomes liable for payment when the online order procedure is completed by confirming the order.
Art. 4 – Registered users
Users registering an account must provide accurate and complete information and keep it up to date. Access credentials must be kept confidential and not shared with third parties. Valdiverdura may suspend services where information is materially inaccurate or incomplete or where payment is disputed until the issue is resolved.
Art. 5 – Product availability
Availability shown on the website refers to stock at the time of ordering but remains indicative because several customers may purchase at the same time. Partial or total unavailability may arise even after an order confirmation. In that event, the unavailable item may be removed and the customer informed promptly.
Where cancellation results in termination of the contract, amounts paid are refunded without undue delay and in any event within the periods required by applicable law.
Art. 6 – Products offered
Società agricola Valdiverdura s.s. offers agricultural products. The current range is shown on shop.valdiverdura.com and changes according to season and availability.
Art. 7 – Prices and payment
The applicable product price is the price displayed on the website, except in the event of an obvious error. If an error is identified, Valdiverdura will contact the purchaser as soon as possible so the order can be confirmed at the correct amount or cancelled.
Prices displayed on the website include VAT. Any shipping charges applicable to the order are shown before purchase. Prices may change at any time, but changes do not affect orders already confirmed.
Payment is made using the methods shown as available at checkout. Any method-specific conditions are displayed before payment is confirmed.
Art. 8 – Delivery
Valdiverdura ships within Italy and to European Union countries enabled at checkout. Standard shipping in Italy is free except for locations classified by GLS as remote or disadvantaged areas, where the surcharge shown at checkout applies. For enabled EU destinations, shipping cost is calculated and displayed in the cart and checkout according to destination and quantity. Vatican City and San Marino are excluded.
Delivery is made to the address supplied by the customer. Delivery generally takes 2–4 business days or, where no date is specified, within the estimate shown when delivery is selected and in any event within the maximum period required by law.
If delivery cannot be completed, the carrier’s storage or redelivery procedures may apply. Applicable shipping costs are always shown before the order is placed.
Art. 9 – Transfer of risk
Risk relating to the goods passes to the purchaser upon delivery. Ownership is acquired once full payment of all amounts due has been received, including any delivery charges, or upon delivery if that occurs later.
Art. 10 – Legal guarantee and conformity
The seller is liable to consumers for lack of conformity existing at the time goods are delivered, in accordance with the Italian Consumer Code. For new goods, the seller’s liability covers lack of conformity that becomes apparent within two years of delivery. Unless proved otherwise, defects appearing within one year are presumed to have existed at delivery, unless incompatible with the nature of the goods or defect.
The legal guarantee does not cover deterioration or damage occurring after delivery due to improper storage, unsuitable use or other causes not attributable to the seller.
Where a lack of conformity is covered by the legal guarantee, the consumer is entitled to restoration of conformity without charge through repair or replacement where those remedies are applicable. In the cases provided by law, the consumer may obtain a proportionate price reduction or termination of the contract. Necessary costs for restoring conformity, including any return or transport costs, are borne by the seller within the limits provided by law.
Art. 11 – Withdrawal
Except for the exclusions under Article 59 of Legislative Decree No. 206/2005, consumers may withdraw from the purchase without penalty and without giving a reason within 14 days from the day they acquire physical possession of the goods, under Articles 52 and following of the Italian Consumer Code.
Where several goods are ordered together but delivered separately, the 14-day period runs from the day the consumer, or a third party appointed by them other than the carrier, acquires possession of the last item.
To exercise the right of withdrawal, email ordini@valdiverdura.com with the order number and purchaser’s name, or send another unequivocal statement expressing the decision to withdraw.
Returns must be sent to Contrada Castellana snc, 92016 Ribera (AG), Italy. The consumer must return the goods without undue delay and no later than 14 days after communicating withdrawal and bears direct return costs unless otherwise stated.
Payments received, including standard delivery costs where applicable, are refunded without undue delay and within the legal time limit. The refund may be withheld until the goods are received or until the consumer provides evidence that they have returned them, whichever occurs first.
The right of withdrawal does not apply in the cases set out in Article 59 of the Italian Consumer Code. In particular, the statutory exclusions include goods liable to deteriorate or expire rapidly.
Refunds are made using the same payment method used for the purchase unless expressly agreed otherwise. For refunds following a bank transfer, the customer may be asked for the bank details necessary to complete the refund.
Art. 12 – Personal data
Personal data processing is described in the Privacy Policy, which forms part of these Terms. Information on cookies and consent preferences is available in the Cookie Policy.
Art. 13 – Severability
If any provision of these Terms is invalid for any reason, that does not affect the validity or enforceability of the remaining provisions.
Art. 14 – Contact
Requests for information may be sent to ordini@valdiverdura.com.
Art. 15 – Applicable law and jurisdiction
These Terms are governed by Italian law, without prejudice to any overriding mandatory rules of the purchaser’s country of habitual residence. Interpretation, performance and termination are therefore subject to Italian law to that extent.
Disputes are handled by the competent judicial authority according to applicable law. Where the user is a consumer, the competent court is the court of the consumer’s domicile or residence where required by law.
